ALL WEBSITE ACTIVITY INCLUDING THE PROMOTIONS CONDUCTED ON THE WEBSITE ARE SUBJECT TO THE TERMS OF SERVICE, PRIVACY POLICY, AND CODE OF CONDUCT
1.NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
2.Eligibility: Open only to persons who are 18 years of age or the age of majority in their jurisdiction of residence (whichever is greater) at the time of entry. Employees of Squarz, its subsidiaries, affiliates, suppliers, advertising and promotion agencies, and their immediate family members (including mother, father, sister, brother, daughter, son or spouse), regardless of where they live; or persons who reside in the same household, whether related or not, are not eligible to win. Open only to persons residing within the contiguous states of the United States of America and the District of Columbia (specifically excluding Alaska, Hawaii, Rhode Island, Puerto Rico, Guam, US Virgin Islands and all territories of the United States) who are a resident or domiciled at a valid street address within the contiguous states or District of Columbia according to the United States Postal Service. You must also have a valid email address to participate. Void wherever prohibited or restricted by law. Persons who meet all of the eligibility requirements and have read and accepted these Official Rules may enter through www.squarz.com. How The Game Works: On www.squarz.com (the “Website”), our registered members have the opportunity to purchase, from Squarz’s merchant sponsors (“Merchants”), vouchers for sale (“Vouchers”) and discount coupons (“Discounts”) which may be exchanged for goods or services or discounts at the Merchants’ online or retail locations. The Website also offers a promotional prize or prizes in connection with each Voucher and Discount deal, subject to the terms of these Squarz Official Game Rules. Any failure by any person to comply with these rules shall result in the forfeiture of any right to a prize or participation in any sweepstakes or give-away promoted on the Website. The things for sale on any given day at any given moment can be found on squarz.com on the squares. Each square (a “Square”) may feature a different Squarz Deal , and often there may be a number of Squares offering the same Squarz Deal. When a member buys the Squarz Deal through one of the Squares, the member is given an opportunity to win a prize or prizes listed and associated with that Square (the “Prize”). Each Square has its own game function and each Prize for such Square will be awarded in a promotional sweepstakes method. Each Square offers a Squarz Deal and each Square has its own sweepstakes (each, a “Promotion”). Each Square offering a Squarz Deal and Prize shall be assigned a unique identification number (eg Square Number. 20345). The opportunity to win the Prize listed on the Square for the particular Squarz Deal is subject to all of the following rules, to which you agree by buying the Squarz Deal on a page and participating by taking your square on the page, or by entering for free as provided by the rules.
There are two random methods by which the recipient of the Prize may be determined (the “Random Methods”).
Traditional Square Method - In this traditional method, the winner is determined randomly using the last digits from the score of a specified sporting event. The result is not based on which team wins. Rather the last number from the score of each team is matched up with a square. First, every one of our Squares for a Squarz Deal has a left side and a top. Every one of our traditional Squares is divided into 10 Rows and 10 Columns creating 100 squares inside the main square. After a member buys the Squarz Deal, they are given the opportunity to select one of the 100 squares. If enough members purchase the Squarz Deal then the Reserve (as defined below) is met and the game is on, and our computers will randomly assign the numbers 0-9 along side the 10 boxes in the Column on the left side of the Square and the numbers 0-9 above the 10 boxes on the top Row of the Square.
Next, when the score comes in and the game is over, the winning square is selected by taking the last digit of the score for each team and matching up with the square. Example: when the score is Chicago 28 v. Detroit 12, “8” is the last digit of “28” and “2” is the last digit of “12” so the winning square is the one which is in Row 8 and also in Column 2. ***In the event the winning square is not assigned to a person through the selection process, the Prize will not be awarded.***
Random Square Method - In the Random Square method there is no event involved. Like the Traditional Square method, the Random Square starts with a square. Every one of our Random Squares may be divided into a number of Rows and a number of Columns creating 100 or more squares inside the main square. After a member purchases the Squarz Deal, they are given the opportunity to select one of the squares. If enough members purchase the Squarz Deal then the Reserve is met and the game is on! Each game on a Random Square will start either when all of the squares are occupied or at a predetermined time after the Reserve is met. Our computers will randomly assign a number to each of the squares using a random number generator. Once each square has been assigned a number, the computer will randomly select a number between 1 and the number of squares on the page by random number generator, and the winning square will the one which had randomly been assigned that number. ***In the event the winning square is not assigned to a person through the selection process, the Prize will not be awarded.***
Auditing and certification of the random number generator used to determine winners and to assign numbers to Rows and Columns is performed by independent third parties having no interest in the Website.
***The Promotion and the game associated with any Square may be cancelled in discretion of Squarz . There is a Reserve requirement for every Squarz Deal. Each Square is sponsored by a designated Merchant, and the Merchant may, in its sole discretion, require that a certain number of Vouchers or Discounts be purchased before the Squarz Deal for the Square will be binding on the Merchant and the Prize for the Square will be offered. If the Reserve for a Squarz Deal is not met, the Voucher or Discount will not be offered, the game will not proceed, and no Prize will be awarded in connection with that Square.***
3.Online Entry Via Purchase: Members who purchase the Squarz Deal through a Square shall automatically receive one chance per purchase to win the Prize designated for that Square only. For each Square, squares may be purchased on a first come, first served and one-at-a-time basis. Unless otherwise indicated, only one entry is permitted per household per Squarz Deal.
4.Online Entry Without Purchase: Persons entering a particular Promotion without making a purchase shall in all instances have the same chance of winning the same Prize or Prizes associated with a particular Square. Whenever a Square for a Squarz Deal is opened and made available to purchasers, the same number of entries shall be made available for selection and registration by persons wishing to participate without making a purchase. (Example: A Square is opened for a Square Deal on the Website comprised of 100 squares. Squarz will open 100 entries for free entry, each of which may be claimed by persons seeking to enter for free on a first come, first served and one-at-a-time basis. From the 100 free entries, a winning entry will be selected by a Random Method). Unless otherwise indicated, only one entry is permitted per household per Squarz Deal.
Every Square through which a Squarz Deal and Prize are offered shall have a link next to the Prize as well as a link through the words “NO PURCHASE NECESSARY TO WIN” for the instructions to check for the availability of a free entry square and to register as a free participant. Where a free entry remains available for that Square, the user will be prompted by the Website how to register to participate.
Only one free entry may be requested per each request for entry without purchase.
If the Reserve is not met for the Squarz Deal, the game associated with the Square will be cancelled and Squarz will attempt to notify any persons having registered to participate without purchase by email of cancellation of the Promotion and will post notice of the cancellation to the Website.
Each Square will have a specified start date/time and end date/time. Squarz’s computer shall be the official clock of the Square. Because each Square shall have its own finite end date, Squarz reserves the right to close registration for a free entry within a commercially reasonable period of time prior to the end date, as well as after all available entries have been assigned.
Persons entering without purchase shall obtain the entry to the Promotion for a particular Square only, and shall not have any right to select a visible square on the Website nor any right to post any content within any visible square on the website.
Where Squarz offers the same Prize through more than one Square on the Website and the number of persons registering for entry without purchase is less than the total number of free entries available, Squarz may consolidate the free entries into one of more groups each equal to the number of total squares comprising each Square. (Example: Merchant authorizes Squarz to sell 1000 Vouchers through 10 Squares each comprised of 100 squares, with a Prize for each of the 10 Squares. The Website opens 10 blocks of 100 available entries without purchase for a total of 1000 free entries. 30 people register to participate without purchase through the links on each of the 10 Squares, for a total of 300 entrants without purchase. Instead of determining the winning spaces among 10 groups of 30 out of 100 spaces, Squarz may determine the winning space among 3 groups of 100 out of 100 spaces. In either grouping under this example, each entrant has a 1/100 chance of winning).
You agree that you will not use or enable any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, "scrape," "data mine" or in any way gather content or reproduce or circumvent the navigational structure or content of the Website.
5.Electronic Entry Only. Availability of entries for a Square is limited and entries are available on a first come, first served, basis. Persons wishing to participate without purchase may access the free entry registration process through the link next to the Prize on a particular Square as well as a link through the words “NO PURCHASE NECESSARY TO WIN” on a Square page, and must provide all information requested on the registration form. Squarz shall not be responsible for late, lost, illegible or scrambled entries. Incomplete entries will not be accepted by Squarz. Squarz shall have no responsibility for connectivity problems, browser compatibility issues, or the inability of your computer, PDA, phone or any other computerized or electronic device to run any Squarz software or graphics necessary to register or participate. The use of automated or third-party software or website to enter is prohibited, and any entries made through such methods will be disqualified. Squarz reserves the right to void all entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such a method.
6.Selection of Winners: Odds of winning any prize depend on the number of squares in a Square and the number of eligible entries. By participating, entrants agree that the decisions of Squarz will be final and binding in all matters relating to each Promotion and release Squarz and its affiliates from all liability concerning the each Promotion. All entries become property of Squarz and will not be returned. No correspondence will be entered into by Squarz to entrant regarding the status of an entry.
7.Prizes: The value of each Prize shall be posted on the Prize page for each Square offering a Prize. Difference between actual value and stated value of a Prize will not be awarded. The Prizes are selected and offered by Squarz’ Merchants, and it shall be the Merchants’ sole responsibility to accurately describe and value the Prizes, and to ship or otherwise deliver any Prize. If winner cannot or will not accept the Prize, or does not claim the Prize, it will be forfeited. Prizes may not be transferred, substituted or redeemed for cash. In the event of unavailability of a Prize, prize(s) of equal or greater value may be substituted at the sole discretion of Squarz or the Merchant providing the Prize. Prizes consisting of a gift card, voucher, coupon or similar device issued by a Merchant may be subject to additional terms and conditions. Please allow 3-4 months from the date you claim your prize, to receive your prize.
8.Taxes. Payment of any federal, state or local taxes and duties are the sole responsibility of the winner. To the extent required by federal law, the value of a Prize may be reportable to the Internal Revenue Service and the winner may be issued a Form 1099.
9.Notification of Winners: Squarz will attempt to notify winners by electronic mail (email) at the email address provided in the registration process. Each winner may be required to sign and return an Affidavit of Eligibility and, where lawful, a Publicity Release, or winner’s prize may be forfeited. By accepting any Prize, winners agree that Squarz and its respective officers, directors, representatives, agents and employees will have no liability or responsibility for any injuries, losses or damages of any kind resulting from the acceptance, possession, use or misuse of any Prize, participation, or inability to participate in the Promotion and they will be held harmless against any claims of liability arising directly or indirectly from the Prizes awarded. By accepting a Prize and executing the Publicity Release, each winner agrees, where lawful, that Squarz may use winner’s name, likeness, biographical information, voice, and statements attributed to winner (if true), for publication, advertising, marketing and promotional purposes without notice or additional consideration.
10.Administration. Squarz reserves the right in its sole discretion to cancel or modify any Promotion. Each entrant is responsible for all on-line charges incurred with any Internet service provider and/or wireless carrier. Squarz is not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures or any telephone network, computer equipment, or software malfunction, inability to access any website or on-line service, or any other error or malfunction, or any other cause beyond the control of Squarz. Squarz is not responsible for damage to entrant’s or third person’s computer and/or its contents, or damage caused by computer virus or otherwise resulting to any computer from entrant's access of the Website, whether human, mechanical or electronic. Squarz reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion, to be acting in violation of these Official Rules, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. If Squarz determines, in its sole discretion, that there is any suspected or actual tampering, unauthorized intervention, fraud, or any other causes which Squarz deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion or if technical difficulties compromise the integrity of the Promotion, Squarz reserves the right to void the entries at issue and/or terminate, suspend or modify the Promotion and/or conduct a random drawing to award the prize using all eligible entries received as of the termination date. If the Promotion is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at www.Squarz.com . Any attempt to deliberately damage the content or operation of this Promotion is unlawful and subject to legal action. NOTE: Entries must be made only by the individual entrant at the authorized mailing or website addresses as specified in these Official Rules (or as otherwise directed on Web site). Entries made by any other individual or entity and/or originating at any other Internet website or email address, including but not limited to commercial Promotion subscription notification and/or entering service sites, will be declared invalid and as such ruled ineligible for this Promotion. Entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Squarz is not responsible for any computer or human error which compromises the administration or proper play of the Promotion. Squarz’s failure to enforce any term of these Official Rules shall not constitute a waiver of that term. All federal, state and local laws and regulations apply. Void where prohibited or restricted by law. Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of Illinois or the appropriate Illinois State Court located in Cook County, Illinois ; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
11.List of Winners: For each Promotion, a list of winners will be posted at the website as soon as reasonably practicable after the conclusion of the Promotion. A link for Winners’ Lists shall be accessible through the Website. Any person may obtain a list of winners for any Promotion by accessing the List and entering the Square Number for the Promotion the person wishes to check.
